From Karl....

Victorian Numbered Regulations
________________________________________
ROAD SAFETY ROAD RULES 2009 (SR NO 94 OF 2009) - REG 18
Who is a pedestrian
A "pedestrian" includes—
(a) a person driving a motorised wheelchair that cannot travel at over 10 kilometres per hour (on level ground); and
(b) a person in a non-motorised wheelchair; and
(c) a person pushing a motorised or non-motorised wheelchair; and
(d) a person in or on a wheeled recreational device or wheeled toy.
Note
"Wheelchair", wheeled recreational device and "wheeled toy" are defined in the dictionary.

" wheeled recreational device " means a wheeled device, built to transport a person, propelled by human power or gravity (or in the case of a scooter, propelled by a person pushing one foot against the ground, or by an electric motor or motors, or by a combination of these), and ordinarily used for recreation or play, and—

(a) includes rollerblades, rollerskates, a skateboard, a scooter that is not a motor vehicle, or similar wheeled device;

(b) does not include a golf buggy, pram, stroller or trolley, or a bicycle, wheelchair or wheeled toy, or a scooter that is a motor vehicle.

" wheeled toy " means a child's pedal car, scooter, tricycle or similar toy.

So it apears that in the state of Victoria Skateboarders are considdered as Pedestrians.

So if they try to issue a fine to skaters under the "no riding bicycles in parks by-law", unless skateboards are also noted in that bylaw, they legally can't.
And Flagstaff gardens is a cool spot to roll.
