Here's something that a friend passed on to me.

I thought it would be pretty handy for skaters  to know this, considering the negative attention we get from the police.

So basically what I take from the article is a person is not obliged to stop for police or answer their questions unless you are under arrest.

Now bear in mind that most police officers don't know the laws they are meant to be enforcing, and if they do manage to catch you, you will probably end up on the ground with a knee in your back or worse.

I'm guessing it's a different story when it comes to people operating motor vehicles, otherwise it would be impossible to do random breath testing and such.

However considering skaters are lumped into a category with pedestrians, we should be in the clear right?

Any of you folks out there with a better grasp of the law care to chime in here?

Cops don't want to be talking to you in the first place so make the exp as short as possible. SO SIMPLE

I guarantee you argue with cops you loss, straight up no ifs or buts.

you are a skateboarder. you are scum. thats the bottom line. argue it as much as you like, between our community we have respect for each other and know what we are doing is not wrong, but in the public eye (and most likely the people who are out to get you) you are a criminal doing the wrong thing at all times... you are on a skateboard, you have no rights!

like kam said, forget arguing with the cops, doesnt matter if your allowed to skate there or not, if a cop doesnt like it and moves you on, you move on. if hes cool and polite, you be cool and polite. you will never win with cops if you carry a skateboard. 

If you dont want to be caught be cops and have to act like a poof saying yes sir no sir three bags full sir you shouldnt have gotten caught by them in the first place! next time you will know to be in and out quick at your skate spots or stop acting like your all over the place

if you act like you have rights to do what you want the copper is just gonna be more angry at you and you will be more likely to get a fine, or worse

is there a book or something with all your rights and stuff? if so where can i get one. not saying i get pulled over often but it would  be  ice to have just in case.

Sorry fellas, the sad fact is that you must answer an officer making an inquiry. Failing to do so will result in them slapping you with an obstruction charge. I studied policing laws as I often needed to refer to them while making an arrest as a Security guard. (Before anyone hates, I was more interested in people commiting REAL crimes, never busted anyone for skating. Thats just dog)

Last time I checked my rights it said I do not have to answer questions or make a statement to the police.

Correct Hop, but refusal to co operate with police by not answering direct questions will, and has, provoke a power tripping cop to charge you with obstruction. It's messed up and entirely one sided, but I have been charged with it and sadly, it stuck in court when I decided to fight it. The best approach is to give vague answers that don't actually tell them anything. Can't charge you with obstruction if you're co opperating with them ;)
