South-East Queensland, Brisbane - board confiscation?

Hey all,

I've been hearing some rumors that if you get caught skating in the city the coppers will confiscate your board? Don't know if this is true, thanks.

im pretty sure they wont unless you directly disobey their orders.

they cant take your board, that is theft... all they can do is write you a ticket, or possible arrest you if you continue to piss them off. confiscation of your property (such as a skateboard) is just not on and they can't do that
In Gympie if u skate down the CBD, they will take your board. Ive seen it happen, this kind of thing does happen. They even threaten to cut them in half for repeat offenders.
well you either live in a real shit area with super shit police who dont follow the rules or crew in your hood don't know how to stand up for their own rights

The LAW states that the penalty for riding a small wheeled recreational toy (ie. skateboard) on a lined road of any speed limit is a fine. No where in the LAW does it say that such small wheeled recreational vehicle can be confiscated, revoked or destroyed.

The LAW does state that if you are caught ''hooning'' in a vehicle (we are NOT vehicles according to the LAW) then it CAN be confiscated, revoked and yes, even destroyed.

If a policeman threatens to take your board away, call him out on it. He or she are acting outside of the rules they are paid to follow and as Jacko said, it is not on.

If you feel so inclined you can find the written laws on small wheeled recreational vehicles online. Print it off, put it in your pocket and have it at the ready when you skate.

If you are using your board as a weapon or using it to deface public property (dunno how but anyway) then they have the right to confiskate (
For the state to confiscate your property there has to be special legislation or the item in question must be illegal to possess. ie drugs, knives. The only time they can confiscate something that it is legal to own is in the circumstance where special legislation allows and the only one I know off the top of my head is the car hoon laws and this is tightly regulated as in they can't confiscate your car because you ran a red light or because of a minor traffic offense.

So stand up for yourself! if you get busted for skateboarding than man up and cop what is a minor fine and move on. If a cop or anybody for that matter threatens to confiscate your board politely inform them you don't believe they have the right to do that and you will be making a formal complaint about the theft of your personal property. I can guarantee you will promptly hear a generous story about how they can rightfully do it if they want to but they aren't gonna do it this time, "but next time!!... blah bla bla"

Same deal with Camera equipment and what not. They can also take it as evidence.

Had my board confiscated as a grom, cop said I had to come down the station with my folks to get it back. Just chucked it in the boot and drove off.
Fri night a few of us got picked up WALKING across the mall with our boards, cops said it was a 500 buck fine for skating there, they took our names and earnestly explained that we were a nuisance Told us to head down the botanic gardens...
The problem with this is that it only states the law, not the penalty for breaking the law. They already know that you have broken the rules and you are just proving it with this printed out. You need to prove that they are breaking the law by taking your equipment. Hard to find.

Thats how life was for us as groms eh Arbi. Back in the old days when cops were rubbing people down, planting evidence and selling drugs, and for some reason our parents respected that

Cops very very often do things they technically do not have the powers to do. They may do this knowingly or unknowingly. A cop confiscating your skateboard is doing it to scare you and try to make you not skate at that spot again. They are not worried about whether they legally are able to take your board or not. So if it happens do not get angry and crazy. Inform the cop they don't have the right to take your board, in a polite and firm manner. Make sure you get the cops details and what station they work at. Then go there and ask for your board back. If they don't give it back, file a complaint or take them to local court, which is where the magistrate will ask the police whether they have the power to take your board. I would be very surprised if the police ever let it get to that stage tho. Most likely they would just give it back to you.
