This morning in Wellington Jackson send me an email about a skateboarding fine Gabe and Api received

gnarliest skateboard fine ever

For those that dont want to follow the link to the blog, here is the text

Email from Jackson:

Gabe and Api just copped the gnarliest fine I’ve ever seen for skateboarding.

We were cruising down to the waterfront to grab some coffee and breakfast this morning, and on the way back we started to cross this extremely quiet road to get over to the other footpath.

There were no other cars in sight as we crossed the road. About half-way across the road we heard a siren blaring so we crossed as quickly as we can to let any emergency vehicles go past, and then turned around to see an undercover cop car pull up and start having a go.

The copper gets out of his car and says “Are you guys looking to get killed or something?” To which we replied, while looking around at the empty street, “What are you talking about? we are just crossing the road, not doing anything wrong”.

He then proceeded to tell us we were skating recklessly all over the road in front of many cars. I told the copper I was riding on the footpath and he said I’m all good, but then asked for identification from both Gabe and Api.

After taking details he then hopped in his car and went through his handbook to find what he could get the boys with. After about 20 mins he got out and handed fines to Api and Gabe for $750 titled “Adult used skateboard recklessly on a road”

By far the most ridiculous fine ever in the world.

For $750, it is almost worth Gabe flying back to have his day in court. Anyone have any NZ law knowledge? Are bikes and skateboards classified as the same thing?

Has anyone had a fine this big in New Zealand?

So I wonder is that some sort of category in NZ law or did he pull that out of his date? If it's law, it's so open to discretionary abuse it's not funny. Can't add any inside info though, Hop.

Total suck, boys. Hope you are able to challenge it and get off. Otherwise that's a few extra shifts you'll be pulling, Gabe....

thats crap......

He must have seen the film...Striker....NZFreeway....skating....cars....trucks....barefoot!

Must be pretty good to join those dots all the way to Gabe and Api.

I would write a letter to NZ court complaining about the over zealous and novel nature of the fine given the circumstances and the damage that it could do to the reputation of NZ as a tourist destination. (administrators hate "over zealous" behavior)

After Christchurch, god knows that NZ will need all the tourism revenue it can get to help with rebuilding shattered lives and buildings.

Penalties

  • First offence - skateboard confiscated. $20 fine to recover it.
  • Second offence - skateboard confiscated. $40 fine to recover it after three working days.
  • Third or more offence - skateboard confiscated. There are fines of up to $750 for skating in a way that puts other people's safety at risk.
Total Bullshit cop.
Thats for a skate park.
They were on a public road:

15. Skateboards and skates

15.1 Use of a skateboard, roller-skates or inline-skates in a public place is allowed, except in areas with signs stating otherwise.

15.2 Every one who uses a skateboard, roller-skates or in-line skates shall ensure no damage is caused to Council property and shall show reasonable consideration for other persons using the public place.

Has he tried to fine you as operating a VEHICLE recklessly? that fine seems massive unless there is no clause in NZ law stating a skateboard is a wheeled recreational device. The fine seems so vague i reckon you could easily get out of it with a decent solicitor. here is a similar case off silverfish

Nice research Rob.

bump
what the fuuuuuuck! shiftiest cop i've ever heard about, i had a cop pull me down on a quiet unmarked road today  and he tried to take my board and give me a fine, i spoke nicely to his partner and agreed to come down to the copshop and check if they could legally fine me or take my gear for skating on such a road, the second she found out i was skating legally her partner left the room didnt say shit and i just walked out of the station... cops are getting too out of control these days...

whoa,750 bucks is huge, not good for brotown,...so he obviously thought you were flaunting the law to the extreme so slapped them with the maximum fine,is there any way of getting that reduced without fighting it in court.

or is the coppers call on the situation final.....because not many people ever recieve the maximum penalty.

I wonder if this fine existed before strikers vid, lol. sounds like it has been targeted quite specifically.

a massive bullshit button, we must build one just so we can press it for this occasion
